Our class action lawsuit against Hyundai Glovis and GFA Alabama is moving forward! We’re thrilled that Rosa Linda, Jimmy, and many other workers are one step closer to getting justice for the fraud and abusive working conditions they endured while working in the US with TN visas.
Just today we received word that the Northern District of Georgia Court, Atlanta Division denied the Defendants’ motion to dismiss with respect to most of the claims included in our class action suit against Hyundai Glovis and GFA Alabama. Our clients’ race, national origin and pregnancy discrimination, fraud and RICO (Racketeer Influenced and Corrupt Organizations Act) claims will all move forward!
Rosa Linda and Jimmy’s experiences follow the same patterns of abuse we’ve seen all too often in the U.S. automotive industry — Kia and Hyundai supply chains in particular: as alleged in the lawsuit, both were recruited in Mexico with the promise of career-advancing engineering jobs in the United States, only to be put to work doing backbreaking manual labor, carrying autoparts and electrical appliances for 12 hours a day. Their responsibilities, working conditions, and pay were nowhere near what they were promised. When they complained about their treatment, their employers threatened, retaliated against, or ignored them. In Rosa Linda’s case, the abuse continued even after she requested a modification in duties to accommodate her pregnancy.
As we move on to the next phase of the case, we will keep fighting alongside our co-counsel at Radford Scott LLP, Beal, Sutherland, Berlin & Brown LLC and Hall & Lampros, LLP until Rosa Linda, Jimmy and other TN workers get justice.
